Oh, the Places You’ll Go! Forum Shopping in Insolvency Proceedings

This interactive workshop will examine the factors to be considered when determining whether and where a corporation should file insolvency proceedings, including a frank discussion on whether it is possible to indeed “forum shop” when it comes to insolvency. We will also examine the likelihood of being able to commence secondary insolvency proceedings in jurisdictions other than where the main insolvency was filed. Lastly, we will also discuss whether there can be any consequences, if a court determines that a debtor improperly filed insolvency proceedings in a particular location where it did not do business or have assets. In addition to a brief presentation by a well-known insolvency practitioner, we expect audience participation as we work through what can be thorny, yet incredibly interesting, questions about where an insolvency proceeding can and should be commenced
